Required Minimum Car Insurance in Illinois

In Illinois, auto insurance is based on liability insurance. It compensates you for any injuries or damage you cause to others. If, on the other hand, another driver is legally responsible for an accident, you can file a claim against their liability car insurance.

In Illinois, car owners must get liability insurance that includes at least:

  • $25,000 for one person's bodily harm.
  • $50,000 for several people injured in a single accident.
  • $20,000 for property damage in a single accident.

State minimums are insufficient for drivers who have money and other assets to safeguard if they are sued. You need a high amount of liability insurance in case you cause a costly accident. Better coverage is depicted in the chart below.

Uninsured motorist coverage is also required in Illinois. UM coverage is only for injuries sustained in an automobile collision, not for vehicle damage. It covers your medical fees if you are hit by a driver who does not have liability insurance or if you are wounded in a hit-and-run.

Underinsured motorist (UIM) coverage is also necessary. This applies to incidents caused by drivers who do not have enough liability insurance to cover your medical expenditures. The difference between the other driver's liability limit and your UIM limit will be paid by your UIM. So, if you have $100,000 in UIM coverage and the other driver only has $25,000, your potential UIM claim is $75,000, not $100,000.

The following are the minimum UM limitations you must purchase:

  • $25,000 for one person's bodily harm.
  • $50,000 for several people injured in a single accident.

What Else Should I Have?

In many cases, the minimum coverage in Illinois does not include coverage for damage to your own vehicle. If your vehicle is stolen or destroyed by floods, hail, fire, a falling tree branch, vandalism, a collision with a deer, or a riot, you could be stuck with a large auto repair bill–or having to buy a new car–if you do not have collision and comprehensive coverage.

If you have a car loan or lease, collision and comprehensive coverage are frequently required.

How Many Uninsured Drivers are in Illinois?

According to the Insurance Research Council, approximately 12% of Illinois drivers do not have insurance. If they hit you, you try to sue them for compensation. Alternatively, you can use your uninsured motorist policy for injuries and collision coverage for vehicle damage.

Penalties for Driving Without Auto Insurance

If you are discovered driving without insurance, you could face a fine of "in excess" of $500 and up to $1,000 for the first offense.

When Can a Vehicle Be Totaled?

If your car is severely damaged, your insurance provider will assess whether it should be declared "totaled." It can also be totaled if the repair costs exceed 70% of the vehicle's fair market value.

There are two ways to get insurance money for a damaged car:

  1. If the accident was caused by someone else, you can file a claim against their liability insurance for the value of your vehicle.
  2. Alternatively, you can file a claim with your own collision or comprehensive insurance. You can do this if someone else smashed into your automobile or if it was totaled due to an issue covered by collision or comprehensive insurance, such as a flood.

Did You Know?

Any object between the driver and the windshield is illegal in Illinois. This may include your fuzzy dice and pine-tree air freshener.

To ensure that drivers have an unobstructed view, Illinois law states that "no person shall drive a motor vehicle with any objects placed or suspended between the driver and the front windshield, rear window, side wings, or side windows immediately adjacent to each side of the driver that materially obstructs the driver's view."

Solving Insurance Problems

The Illinois Department of Insurance is in charge of overseeing insurance businesses and dealing with consumer complaints. Complaint forms are available online from the department.
